CONSULTANCY SERVICES FOR FINALIZATION OF DRAFT TRANSBOUNDARY WATER POLICY AND DEVELOPMENT OF TRANSBOUNDARY WATER BILL

CONTRACT NO.: MOWSI/SDWS/HoAGW4RP/008/2023-2024 (KE-MOWI-353653-CS-QCBS)

1. The Government of Kenya has received financing from the World Bank toward the cost of the Horn of Africa Ground Water for Resilience Project (HoAGW4RP), and intends to apply part of the proceeds toward payments under the contract for CONSULTANCY SERVICES FOR FINALIZATION OF DRAFT TRANSBOUNDARY WATER POLICY AND DEVELOPMENT OF TRANSBOUNDARY WATER BILL contract No.: MOWSI/SDWS/HoAGW4RP/008/2023-2024 (KE-MOWI-353653-CS-QCBS)

2. The objective of the assignment is to review and finalize the draft Transboundary Water policy and Develop Transboundary Water Bill. The Policy and the Bill documents prepared will fully inform the Government of Kenya (GOK) and its future decisions. The two documents will provide a clear framework for sustainable management of transboundary water resources, clarify roles and responsibilities, increase accountability, reduce conflict, improve the integrated management of resources, provide water security for present and future generations, and optimize public funds through more effective use of resources

3. The duration of the consultancy services will be for a period of Thirty Six (36) Months, but signed into two phases. The first Eighteen (18) Months for Finalization of the Policy Document, while the last Eighteen (18) Months will be for drafting of the transboundary water bill

 4. The detailed Terms of Reference (TOR) for the assignment can be found at Ministry’s website www.water.go.ke and PPIP portal https://tenders.go.ke free of charge.

5. The Ministry of Water, Sanitation and Irrigation, State Department for Water and Sanitation now invites eligible consulting firms (“Consultants”) to express their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The short-listing criteria are:

a. 10 years relevant experience in the field of the  assignment.

b. The consultancy firm to demonstrate having undertaken at least 2 contracts of similar size and complexity within the last 5 years in the following areas:

  • Public Policy formulation, Legislation development, implementation and management, Legal Frameworks related to shared water resources implementation within the water sector and related policies, institutional reforms,
  • Transboundary integrated water resources development, management and planning studies including ground and surface water environments, catchment management, stakeholders’ management and engagement, and including Transboundary water governance. (Proof of this including the references of the respective clients must be provided in the tender document)

c. Must have a good knowledge of policy formulation and governance in Kenya.  

d. Demonstrated technical, managerial, and capabilities of the firm.

6. The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” July 2016 and revised in September 2023 (5th Edition)  setting forth the World Bank’s policy on conflict of interest.

7. Consultants may associate with other firms to enhance their qualifications, but should indicate clearly whether the association is in the form of a joint venture and/or a sub-consultancy. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected.

8. The Consultant will be selected in accordance with the Quality and Cost Based Section (QCBS) method set out in the Procurement Regulations.

10. Expression of interest must be delivered in a written form to the address below in person or by mail or by e-mail so as to be received on or before 6th May, 2024 at 1000 hours Local Time.
